The short answer

Mustang Fencing Services installs and repairs wood, vinyl, chain-link, aluminum and wrought-iron fences, plus driveway gates, automatic gate openers and commercial fencing, for Fresno, TX from our Galveston base at 1105 Avenue H. Fresno is an unincorporated community in Fort Bend County, bordering Pearland and near Manvel. The county’s engineer states that Fort Bend County has not adopted zoning ordinances and has not adopted building codes for single-family residential developments, so the usual city height and permit rules do not apply in unincorporated areas. What does apply: deed restrictions or an HOA if your subdivision has them, any easements on your lot, county permits for floodplain work and work in county road right-of-way, and the rules of any city, Extra-Territorial Jurisdiction or Assistance District that covers your address.

Fence rules in unincorporated Fresno

Most Texas fence questions – how tall, how close to the street, whether you need a permit – are answered by a city ordinance. Fresno doesn’t have one, because it isn’t a city. A January 2024 verification letter from the Fort Bend County Engineer says the county has not adopted any zoning ordinances, tells owners to check with cities for their city limits and Extra-Territorial Jurisdictions, and says the county has not adopted building codes for single family residential developments. In our review of the county’s published pages we found no county fence height or material rule.

The county does require permits in unincorporated areas for certain work: anything within a mapped floodplain, an enclosed structure or slab of 400 sq ft or more, fill or excavation over set limits, and work in the right-of-way of county-maintained roads and drainage ditches. The page doesn’t name fences either way, so we won’t tell you a fence permit is or isn’t required. Ask Fort Bend County Engineering at 281-633-7500 about your lot, especially if it may be in a flood hazard area or the fence will sit near a county road or ditch. You can check flood status at the FEMA Flood Map Service Center.

The rules that most often decide a Fresno fence are private: deed restrictions and HOA approvals, which the county’s own letter points owners to, plus the easements on your plat or survey. If your address is inside a city, its Extra-Territorial Jurisdiction or a Fort Bend County Assistance District, check that body’s requirements too.

Four panels. Unincorporated Fort Bend County: no adopted zoning or single-family building codes. Inside a city, its ETJ or an Assistance District: that body sets the rules. County permit triggers: floodplain work, structures or slabs of 400 square feet or more, large fill, and work in county right-of-way, with fences not named. Private rules still apply: deed restrictions, HOA approval and easements. Planning a driveway or yard gate in Fresno

Larger Fresno lots often call for a drive gate as well as a fence. Decide three things before anything is ordered: the opening width, which way the gate swings or slides, and whether you want an automatic opener now or later. A double gate’s leaf width is simply the opening divided by two – a 14 ft opening gives two 7 ft leaves, and each sweeps a 7 ft radius when it opens, so beds, steps and slabs have to stay out of that arc. A sliding gate needs a clear run beside the drive instead.

If the gate sits near a county road or roadside ditch, set it back far enough that the swing stays on your side of the property line and out of the drainage path. Your survey shows the line; the county can tell you about its right-of-way.

Plan view of a lot with a house, a fence line set inside the property line, a roadside ditch and right-of-way strip along the county road, and a double drive gate with dashed swing arcs. A side panel works the gate arithmetic: a 14 foot opening split into two 7 foot leaves, each sweeping a 7 foot radius, and a five-step checklist before building. PLAN VIEW: A LOT ON A COUNTY ROAD WITH A DRIVE GATE county road roadside ditch / right-of-way: keep the fence out property line (confirm on your survey) house fence line, set inside the property line drive gate, set back from the road GATE SWING – EXAMPLE ARITHMETIC Double drive gate, two leaves that swing in: Opening width: 14 ftLeaf width = 14 ft / 2 = 7 ftEach leaf sweeps a 7 ft radius into the yard. Single swing leaf instead: 14 ft radius.A sliding gate needs a clear run besidethe drive at least as long as the opening.Keep these paths free of beds, slabs, ditches. BEFORE THE FENCE GOES IN 1. Locate the property line on your survey2. Mark ditches, drainage and easements3. Ask the county if you touch road right-of-way4. Get deed-restriction / HOA approval5. Questions we get about this

Do you install fences and gates in Fresno, TX?
Yes. We install and repair wood, vinyl, chain-link, aluminum and wrought-iron fences, plus driveway gates, automatic gate openers and commercial fencing, for Fresno from our Galveston base.
Do I need a permit for a fence in Fresno?
Fresno is unincorporated, and Fort Bend County says it has not adopted zoning ordinances or single-family building codes. The county does require permits for work in a mapped floodplain, for structures or slabs of 400 sq ft or more, and for work in county road right-of-way and ditches, but its page doesn’t name fences. Ask Fort Bend County Engineering at 281-633-7500 about your lot. If your address is inside a city or an Assistance District, its rules apply instead.
How tall can a fence be in Fresno?
We found no county height limit for unincorporated Fort Bend County, since the county has not adopted zoning. Deed restrictions or an HOA may set one for your subdivision, and a city or district would apply its own rule if you are inside it. Check your deed restrictions before you choose a height.
Do HOA or deed restrictions apply in Fresno?
If your subdivision has them, yes. They are private rules separate from the county, which tells owners to refer to their deed restrictions. They can limit height, material, color or placement. Get written approval first.
How do I know if my Fresno address is in a city, an ETJ or unincorporated Fort Bend County?
Your survey, tax bill or closing paperwork shows which jurisdictions your lot is in, and the county can help confirm it. The county advises checking with cities about their city limits and Extra-Territorial Jurisdictions.
Do you build driveway gates and automatic gates in Fresno?
Yes. We build walk gates and driveway gates and install automatic gate openers and access control. Plan the opening width and swing first: a 14 ft double gate has two 7 ft leaves, each sweeping a 7 ft radius.
