What does Santa Fe’s code actually require for your fence?

Answer two questions. Santa Fe’s own Code of Ordinances only singles out two kinds of fence - everything else is unaddressed, so this tells you which case you’re in before you call the City.

Santa Fe’s Code of Ordinances doesn’t set a general fence rule - here’s what it does say

Most of the Galveston-area cities on this site have a zoning chapter that sets fence height, setback and material rules by yard. Santa Fe doesn’t have one. Its Code of Ordinances runs ten numbered chapters plus the Home Rule Charter, and the construction-regulations chapter (Chapter 3) that would normally carry fence rules instead covers the adopted building codes, flood and drainage regulations, mobile home parks and similar topics - a full search of its 29 sections turns up exactly two places where "fence" appears in a way that sets a real requirement.

The first is pool fences: Santa Fe has adopted the 2018 International Swimming Pool and Spa Code, which regulates "water supply, waste, electrical, lighting, fencing and safety" for pools and spas (Ch. 3, Sec. 10, Ord. No. 21-2020) - on top of the separate Texas pool-safety law that applies no matter what a city’s own zoning says. The second is the mobile home park boundary: Sec. 28(A)(1) defines a "natural or artificial barrier" - which can be a fence, hedge, or several other options - required at a park’s edge, and requires it to be at least 6 feet tall and 100% opaque. That rule only reaches the boundary line itself, not a fence anywhere else in the park or on an ordinary single-family lot.

For every other fence in Santa Fe - a backyard privacy fence, a driveway gate, a side-yard fence between two houses - there is simply no published height, setback or material number to look up. Rather than guess at one, or borrow a number from League City or Kemah’s very different codes, we confirm the plan directly with the Building Official, (409) 925-6412, before ordering material.

Before you order fence material in Santa Fe

With no general ordinance to check against, the practical path is to rule out the two cases Santa Fe’s code does cover, then call ahead for everything else - especially on this low, drainage-ditch-laced stretch of the county.

A three-step decision flow. Is this a pool fence - yes means the adopted pool and spa code and state law apply. Is the lot inside a mobile home park - yes at the boundary means a 6 foot, fully opaque barrier is required. Anything else, a typical house yard or driveway fence - no rule is published, agree with your neighbor and call the Building Official, especially near a drainage ditch. IS THIS A POOL FENCE? Yes - the adopted 2018 International Swimming Pool and Spa Code, plus Texas's own pool- safety law, apply regardless of city zoning (Ch. 3, Sec. 10, Ord. No. 21-2020). No - keep going. IS THE LOT INSIDE A MOBILE HOME PARK? Yes, at the park's boundary line - the required "natural or artificial barrier" must be at least 6 ft tall and fully opaque (Ch. 3, Sec. 28(A)(1)). No, or not at the boundary - keep going. ANYTHING ELSE - A TYPICAL HOUSE, YARD OR DRIVEWAY FENCE No height, setback or material rule is published. Does Santa Fe have its own fence height or setback rules?
No general rules are published. A full check of the City’s Code of Ordinances (Chapters 1-10, checked October 9, 2026) found only two fence-specific provisions: one for pool fences and one for mobile-home-park boundary barriers.
