The short answer

Mustang Fencing Services installs and repairs wood, vinyl, aluminum, ornamental iron and chain-link fences, plus driveway, electric and commercial gates, for Clear Lake Shores, TX from our Galveston base. Clear Lake Shores is a very small (0.4 sq mi) incorporated city on Clear Lake, within Galveston County, sharing ZIP 77565 with neighboring Kemah - but it runs its own zoning code. A residential fence is capped at 4 ft 6 in in the front yard (and on a corner lot within 20 ft of the street) or 6 ft 6 in in the side or rear yard; commercial zoning allows up to 8 ft 6 in; and the City’s own P-1 waterfront easement district is carved out of this entire article, with no published height rule in its place.

What does your Clear Lake Shores fence need to clear?

General guidance, not a permit decision: the Clear Lake Shores Building Department makes the actual call, (281) 334-2799, 1006 S Shore Drive. Based on the City of Clear Lake Shores FAQ and Code of Ordinances, Chapter 82, Article III (Secs. 82-281 to 82-287), checked October 13, 2026.

Clear Lake Shores sets height by yard, not one townwide number

Clear Lake Shores' Code of Ordinances, Chapter 82, Article III, gives a residential fence two different caps depending on where it sits: 4 ft 6 in in the front yard, or on a corner lot within 20 ft of the street (the same limit as a front yard), and 6 ft 6 in in the side or rear yard (Sec. 82-284). The City's own FAQ page says height is measured "from the lowest ground elevation, within 3 feet of either side of the lot line that is along and nearest to the proposed fence" to "the uppermost part of the fence structure"; the ordinance text itself (Sec. 82-284(a)(3)) phrases the same idea as measuring "from grade at the base of the fence to the uppermost part of the fence." Neither wording contradicts the other - both reach the same point, the top of the fence, from essentially the same starting line.

A fence building permit, approved by the building official, is required before work starts (Sec. 82-283). The fee itself is set by city council resolution rather than published as a fixed number, so we tell customers to confirm the current amount directly with the Building Department, (281) 334-2799, rather than guess at it.

Three panels. Left: a front yard fence, or a fence on a corner lot within 20 feet of the street, is capped at 4 feet 6 inches. Middle: a side or rear yard fence in a residential zone is capped at 6 feet 6 inches, taller than the front-yard limit. Right: height is measured two ways by two City sources - the FAQ measures from the lowest ground elevation within 3 feet of the lot line nearest the fence, the ordinance text measures from grade at the fence base - both reaching the same point, the top of the fence. FRONT YARDand corner lots within 20 ft of the street Capped at 4 FT 6 IN same limit for both cases Sec. 82-284 Measured to the uppermost part of the fence SIDE & REAR YARDResidential (R-1, A-1) Capped at 6 FT 6 IN taller than the front-yard limit Sec. 82-284 (281) 334-2799, Building Department HOW IT’S MEASUREDTwo City phrasings FAQ: from the lowestground elevation within 3 ftof the lot line nearestthe fence Code Sec. 82-284(a)(3): fromgrade at the fence’s base Both reach the samepoint: top of the fence Neither source conflicts on substance

Commercial zoning, the waterfront easement district, and what can’t be used anywhere

Commercial zoning (C-1, C-2, C-3, NC, M-1) is a different rule, not just a taller version of the residential one: up to 8 ft 6 in, and where that commercial lot sits adjacent to a residential property, the fence must be built at least 6 ft high - a minimum, not only a maximum (Sec. 82-284).

The City also carves out a P-1 waterfront easement district: Sec. 82-281 states this entire fencing article "shall apply to all zoning districts of the city except the waterfront easement district (P-1)." Neither the ordinance nor the City's FAQ states what height or permit rule, if any, takes its place inside that district - so if your property is in P-1, we tell customers to confirm directly with the Building Department rather than assume the area is unregulated.

One rule applies everywhere, regardless of district: Sec. 82-285 prohibits broken glass, barbed wire, protruding spikes, nails, or similar materials designed to inflict pain or injury on any fence, citywide.

Three items. Left: commercial zoning allows a fence up to 8 feet 6 inches, and at least 6 feet high where the lot is adjacent to a home, a minimum rather than just a cap. Right: the P-1 waterfront easement district is excluded from this fencing article entirely, with no published height or permit number taking its place - confirm directly rather than assume it is unregulated. Bottom banner: broken glass, barbed wire, protruding spikes, nails, or similar materials designed to inflict pain or injury are prohibited on any fence, in any district, citywide. Questions we get about this

Do you install fences and gates in Clear Lake Shores, TX?
Yes. We install and repair wood, vinyl, aluminum, ornamental iron and chain-link fences, plus driveway, electric and commercial gates, for Clear Lake Shores homeowners and businesses from our Galveston base.
How tall can a residential fence be in Clear Lake Shores?
4 ft 6 in in the front yard, or on a corner lot within 20 ft of the street. 6 ft 6 in in the side or rear yard (City of Clear Lake Shores Code of Ordinances, Ch. 82, Art. III, Sec. 82-284).
How is fence height measured?
The City’s FAQ measures "from the lowest ground elevation, within 3 feet of either side of the lot line that is along and nearest to the proposed fence" to "the uppermost part of the fence structure." The ordinance text (Sec. 82-284(a)(3)) phrases it as measuring from grade at the base of the fence to its uppermost part - both reach the same point.
Do I need a permit for a fence in Clear Lake Shores?
Yes. A fence building permit must be submitted and approved by the building official before you start (Sec. 82-283). The fee is set by city council resolution rather than published as a fixed number, so confirm the current amount when you apply.
How tall can a commercial fence be?
Up to 8 ft 6 in (C-1, C-2, C-3, NC, M-1 zoning). Where the commercial lot is adjacent to a residential property, the fence must be at least 6 ft high - a minimum, not just a cap (Sec. 82-284).
What about a fence in the P-1 waterfront easement district?
The fencing article (Sec. 82-281) explicitly does not apply inside the P-1 waterfront easement district, and no published rule takes its place. If your lot is in P-1, confirm directly with the Building Department rather than assume it is unregulated.
Are there material restrictions?
Yes, citywide: broken glass, barbed wire, protruding spikes, nails, or similar materials designed to inflict pain or injury are prohibited on any fence, in any district (Sec. 82-285).
